Booking Terms and Conditions

These terms and conditions are a binding agreement between the ‘Dog Owner’ as mentioned on the invoice (hereafter referred to as ‘You’) and DOGSTAYS SARL-S (hereafter referred to as ‘DogStays’) and are with reference to DogStays having assisted You to contact and book a care provider (hereafter referred to as ‘Dog sitter’) for your dog (hereafter referred to as the ‘Booking’), as mentioned in the Booking Confirmation.

Please note that by paying the attached Booking Invoice and Booking through DogStays SARL-S, You confirm that you understand the below terms and conditions which are written in English and have read, understood and accepted them. If you have any problems understanding these terms and conditions, please contact DogStays at the e-mail or postal address mentioned in the Contact Details section.

1. Obligations, representations and warranties of Client

  • You understand that your Booking for any service begins on the ‘Start Date’ and finishes on the ‘End Date’ as mentioned in the Booking Confirmation document sent to you by DogStays.

  • You agree to pay the Dog sitter the amount mentioned in the ‘Remaining payment to be made to the dog sitter’ section of the Booking Confirmation.

  • You agree not to engage the services of the Dog sitter directly in future, for the purposes of looking after your dog(s) and to only make bookings with this Dog sitter through DogStays.

  • For a Booking involving overnight boarding in the Dog sitter’s home, You agree to drop your dog(s) to the Dog sitter’s place on the ‘Start Date’ and pick the dog(s) up on the ‘End date’ as mentioned in the Booking Confirmation.

  • For a Booking involving overnight boarding, in your home or the Dog sitter’s home, if for any reason You are not able to return to your home on the ‘End date’ as mentioned in the Booking Confirmation document, it is your responsibility to inform DogStays and the Dog sitter at least 48 hours in advance.

  • For a Booking involving overnight boarding, in your home or the Dog sitter’s home, if for any reason You are not able to return to your home on the ‘End date’ as mentioned in the Booking Confirmation document, and even if You have informed DogStays, You understand that DogStays cannot guarantee that it will be possible for the Dog sitter to extend the Booking.

  • For a Booking involving overnight boarding, if for any reason You are not able to return to your home on the ‘End date’ as mentioned in the Booking Confirmation document, you allow the Dog sitter to notify the ‘alternate guardian’ if You specified one in the Information form you completed before the start of the Booking. The Dog sitter will be released from the care of your dog(s) as from handing over your dog(s) to the alternate guardian.

  • You acknowledge and confirm that the Dog sitter will use his/her best judgement in the care of your dog(s) and will be the ultimate decision maker regarding your dog(s) during the duration of the Booking.

  • In the case of an emergency, the Dog sitter is responsible for contacting You on the numbers provided in the information form. If the Dog sitter is unable to reach You or your emergency contact for some reason, You allow the Dog sitter to act as the caretaker for your dog(s) and act according to the Dog sitter’s best judgement regarding the care and safety of your dog(s).

  • If the Dog sitter or another person is injured, bitten or exposed to any disease or ailment because of your dog(s), You will be responsible for all costs and damages that may be incurred as a result.

  • In the case of any damage to the Dog sitter’s residence or any other property caused by your dog(s), You agree to bear the cost for all repair/replacements that might be required to put the property back into its initial state. Consequently, You will be responsible for all costs (including but not limited to medical care, legal fees etc.) if your dog(s) should bite or injure another animal or cause damage to any public or private property.

  • Please note that in Luxembourg, your private liability insurance might not cover any liability related to this booking since this is a commercial transaction and might fall outside the scope of the insurance. You understand and accept this risk and take responsibility to check this with your insurance provider if required.

2. Payment

  • You understand the DogStays service and to confirm your Booking with DogStays, You agree to make a payment of 20% of the entire cost of the Booking to DogStays via bank transfer as the Booking Amount, within 72 hours after DogStays sends you the invoice for the Booking Amount.

  • For a Booking involving overnight boarding, if You fail to pick up your dog(s) on the ‘End Date’ mentioned in the Booking Confirmation, You agree to pay DogStays an amount of euros 60 per extra day.

  • In case within 3 days after the ‘End Date’, You have not picked up your dog(s) and/or You have not communicated a new ‘End Date’ to DogStays or the Dog sitter and the Dog sitter was not able to hand over your dog(s) to the alternate guardian, the Dog sitter is entitled to place the dog(s) in foster care/a shelter and notify the relevant authorities.

3. Supplies

  • For a Booking involving overnight boarding You agree to provide the Dog sitter with all the relevant documents and supplies mentioned in the checklist sent to you by DogStays. Supplies must be provided in sufficient quantities for the entire duration of the Booking. If additional items need to be purchased in your absence – i.e. dog food, litter, cleaning supplies or other necessary items that contribute to the health and well-being of your dog(s), You allow the Dog sitter to purchase these at your expense up to an amount of euro 50. Over this threshold, your approval will be requested prior to the purchase, except in case of an emergency. The Dog sitter will retain a receipt of all purchases made and You agree to reimburse the cost of these items at the end of the Booking.

4. Information

  • You agree to provide DogStays and the Dog sitter with information and documentation that is needed to facilitate the Booking (including but not limited to your contact details, your address, photos of your dog, copy of your identification card, original or copy of your dog’s pet passport, original or copy of your dog’s vaccination record etc.).

  • You accept that DogStays will share this information with one or more persons as part of facilitating the Booking and cannot be held responsible for what this person might do with the information shared.

  • You understand that DogStays will retain the information shared for a duration of 1 year from the date the information has been shared with DogStays or 1 year from the date of your last Booking.

  • In case You need to modify this information, You need to contact DogStays at the e-mail or postal address mentioned in the Contact Details section.

5. Medical Care

  • For a Booking involving overnight boarding, in case your dog(s) need(s) to be taken to the veterinarian in your absence, You allow the Dog Sitter to spend up to the maximum amount as mentioned in the DogStays Information Form and You agree to reimburse all related costs including but not limited to medical bills and travel expenses.

6. Cancellation

  • You understand that for all bookings that start between 1st January and 30th November, the 20% Booking Amount paid via bank transfer to DogStays will not be reimbursed if You cancel the Booking less than 30 days before the ‘Start Date’ mentioned in the Booking Confirmation.

  • You understand that for all bookings that start between 1st and 31st December, the 20% Booking Amount paid via bank transfer to DogStays will not be reimbursed if You cancel the Booking less than 60 days before the ‘Start Date’ mentioned in the Booking Confirmation.

  • In case DogStays or the dog sitter need to cancel the Booking due to an unforeseen situation the 20% Booking Amount will be refunded in full. DogStays will also do its best to help You find an alternate Dog sitter but in case an alternate Dog sitter is not available, DogStays cannot be held liable for any other indirect loss due to the cancellation of the Booking (including but not limited to flight and hotel bookings or any other arrangements).

7. Liability

  • You accept that DogStays is acting only as a facilitator between You and the Dog sitter, that the Dog sitter will take care of your dog(s) to the best of his/her ability and You agree that DogStays cannot be held liable for any harm or injury to your dog(s) at any time during the Booking.

  • You acknowledge that it is your sole responsibility to determine if the Dog Sitter’s service is appropriate for your dog(s) and it is solely your decision to entrust your dog(s) to the care of the Dog sitter and You take full responsibility for that decision.

  • For a Booking involving overnight boarding at the Dog sitter’s home, You accept that the Dog sitter might be looking after other dog(s) at the same time as the Booking and DogStays will not be responsible for any lack of such information provided on the part of the Dog sitter.

  • You understand that potential harm could occur to your dog(s) while in the care of the Dog sitter and agree to release and hold harmless DogStays from all liability should your dog become lost or injured.

8. Law and Jurisdiction

  • These terms and conditions are subject to the laws and jurisdiction of the Grand- Duchy of Luxembourg and any dispute will be settled by the competent authority within the city of Luxembourg.

10. Updating of Terms and Conditions

  • Please note that DogStays may update or change these terms and conditions and it is your responsibility to read the applicable terms and conditions before proceeding with the payment for any Booking.
